Title:Return request for the goods under the non-refundable clause of the transaction terms

 

 

Question

I bought a pair of shoes on an internet shopping mall. Once the item delivered, however, I felt like I was no longer interested in the shoes. Hence I tried to return the goods. But claiming the non-refundable clause of the transaction terms posted on its internet shopping mall, the seller refused to accept my return request. Even if the seller has posted such transaction terms (which I have realized later), his refusal to accept my return request seems unfair and not justifiable. Under these circumstances, may I return the shoes?

 

Answer

In case of the goods purchased on an internet shopping mall, a consumer shall be allowed to return the goods within seven days from the date the subject goods have been supplied, pursuant to the Act on the Consumer Protection in Electronic Commerce, etc. If the return has been made due to the causes attributable to the consumer including dissatisfaction with color, design, size, etc., however, the consumer shall pay for the return shipping charges.

 

Even though the seller has posted the non-returnable or exchangeable terms and conditions on its internet shopping mall, Article 35 of the aforesaid Act shall rescind such terms. Consequently, the consumer shall be allowed to return the goods for full refund of purchase price unless the value of the goods has significantly decreased to a level that makes the seller to have difficulties in resale of the subject goods.
