Outline of the case
A consumer purchased USD 150 worth of shoes via a mobile shopping application advertised by a social networking service. During the customs clearance, the authority has confiscated the goods for the reason of counterfeit suspicion. So the consumer asked the seller to provide a certificate of authenticity for the subject goods, but he has not presented such documents to date. Instead, the seller said he is willing to pay 50% of the customs duties levied or to issue a refund in exchange for return of the goods. Given the unjustifiable replies as well as likelihood of fraud transaction, however, the consumer demands the seller to revoke all transactions and to issue a 100% refund.
Judgement
We have reviewed the correspondences between the consumer and the seller and looked into the online shopping site operated by the seller. From the investigation, we have drawn a conclusion that the subject shopping mall is hardly legitimate and performs abnormal transactions. Hence we have advised the consumer to file a claim against the seller to her credit card issuer. The chargeback service offered by credit card companies can be one of the most effective solutions for this case if sufficient evidences proving the consumer’s claims are filled.
