Refund request for missing sunglass during return shipment

 

Question:

I bought a pair of sunglasses for KRW 524,500 via an online shopping mall. Due to personal reasons, however, I returned the items immediately after receiving the package. While the tracking info confirmed the return shipping had been made successful, the shopping mall said one of the items was missing during the return shipment. Upon my refund request, the shopping mall claimed it would not make a refund for the missing sunglass May I get the refund?
 

Answer:

In most cases, a buyer (consumer) is required to present enough evidence for a return shipment with exact quantities of the products. Given the tracking info confirming the very fact of the return shipment, however, it is acknowledged that you have performed all the works which were supposed to be done. On the contrary, it is deemed that the seller (online shopping mall) was negligent to do its part and should immediately have informed you of the missing product when it inspected the returned package.
 

Pursuant to Clause 5 of Article 17 of Act on the Consumer Protection in Electronic Commerce, etc. in Korea also holds the seller responsible for proving its fiduciary duties and liabilities in the cases like yours. Under the circumstances at present, therefore, we view you are entitled to request the seller to issue a full refund for the pairs of the returned sunglasses and the seller shall honor your refund request accordingly.
